Please read these Terms & Conditions ("Terms") carefully before using the services provided by Skyreach Creatives ("Agency", "we", "us", or "our"). By engaging with us, you ("Client") agree to be bound by these Terms.
1. Definitions
- "Project" refers to the scope of work described in the proposal, invoice, or Statement of Work (SOW).
- "Deliverables" refers to the final products (websites, code, designs, reports) created for the Client.
- "Content" refers to text, images, videos, and data provided by the Client for use in the Deliverables.
2. Scope of Services
Skyreach Creatives agrees to provide the services specifically outlined in the SOW or invoice. Any additional work outside this scope ("Scope Creep") will be charged at our standard hourly rate of ₹2,500/hour or as a separate fixed-cost project. We strictly do not provide "unlimited" revisions unless explicitly stated.
3. Business Hours & Service Availability
Service delivery timelines (e.g., "24-Hour Delivery") are calculated based on our operational hours.

General development, support, and meetings.
Skyreach Express
Fast-track services (Logos, Video Edits, etc.)
*Requests received outside these hours begin processing the next business day.
4. Financial Terms
4.1 Payment Schedule
- 50% Advance: Required to schedule resources and commence work. This deposit is non-refundable.
- 50% Completion: Due prior to the live deployment on the Client's domain.
4.2 Late Payments: Invoices are due upon receipt. A late fee of 5% per week may be applied to balances unpaid after 7 days. Skyreach Creatives reserves the right to suspend services or take down websites if payments are more than 14 days overdue.
4.3 GST & Taxes: All quotes are exclusive of GST (18%) unless otherwise stated. The Client is responsible for all applicable taxes.
5. Intellectual Property (IP) Rights
5.1 License to Use: Upon full payment of all fees, Skyreach Creatives grants the Client a perpetual, non-exclusive, worldwide license to use the final website for its intended business purpose.
5.2 Agency Ownership: To ensure long-term security and performance, Skyreach Creatives retains ownership of the underlying source code, development frameworks, and pre-existing libraries used to build the Project. The Client is paying for the result (a functioning website), not the raw code.
5.3 Source Code Buyout: If the Client wishes to obtain full ownership and transfer of the raw source code (e.g., to move to another agency), a separate Source Code Buyout Fee (typically 30% of the total project value) applies.
6. Client Obligations & Delays
The Client agrees to provide all necessary Content (text, images, credentials) within the timelines agreed upon. If the Client delays providing content by more than 10 business days, the Agency reserves the right to:
- Place the project on hold.
- Re-schedule the project based on current availability (which may cause significant delays).
- Bill for work completed to date.
7. Revisions
Unless specified otherwise, our standard pricing includes two (2) rounds of revisions during the design phase. Revisions are defined as minor tweaks to existing layouts (e.g., color changes, font swaps, text updates). Structural redesigns or new feature requests are not "revisions" and will be billed additionally.
8. Warranty & Support
8.1 Bug Fixes: We provide a 30-day warranty period after launch to fix any bugs or broken links related to our code. This does not cover issues caused by third-party plugins, hosting updates, or Client modifications.
8.2 Browser Compatibility: We guarantee the website will function correctly on modern browsers (Chrome, Firefox, Safari, Edge) released within the last 2 years. We do not support Internet Explorer.
8.3 No SEO Guarantee: While we follow SEO best practices, we cannot and do not guarantee specific rankings on Google or other search engines, as these algorithms are outside our control.
9. Termination
Either party may terminate the project with 7 days' written notice. In the event of termination:
- The Client must pay for all work completed up to the termination date.
- The 50% deposit is non-refundable.
- If the Client terminates, no IP licenses are granted until payment for completed work is settled.
10. Limitation of Liability
In no event shall Skyreach Creatives be liable for any lost profits, data loss, or incidental damages arising from the use of our services. Our total liability is strictly limited to the amount paid by the Client for the specific project.
11. Governing Law
These Terms are governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Ghaziabad, Uttar Pradesh.
